The Software, copyrighted symbols and clip art cannot be used for the production of labels by others for resale. You may not permit other users to use the Software. You may not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software. You may not transfer the Software or this license to any other party. You may not remove any proprietary notices on the Software.

Disclaimers and Limitation of Liability. THE SOFTWARE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. Electromark does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error free, and no warranties are made as to the results that may be obtained from the use of the Software, or as to its accuracy, reliability, or currency. Under no circumstances shall Electromark or any other party involved in creating, producing, or distributing the Software be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to lost profits, pursuant to any legal theory or cause of action, even if Electromark has been advised of the possibility of such damages. Under no circumstances shall damages exceed the amount actually received by Electromark from you for such Software. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states liability is limited to the fullest extent permitted by law.

The information contained on the prewritten chemical label data files was compiled from the most reliable sources available to Genium Publishing Corporation and is presented with reasonable care. The information presented on these data files was developed in accordance with ANSI standard Z129.1-1994 for precautionary labeling and other label standards. Reasonable care has been taken to prepare these data files to comply with the OSHA Hazard Communication Standard, but it is the user’s responsibility to determine the fitness of the information for the user’s application. Neither Genium nor Electromark make any guarantee or warranty, either expressed or implied, as to the merchantability, fitness, accuracy or completeness of this information.

Title. All right, title and interest in and to the Software shall remain with Electromark and its suppliers, including all ownership rights, and intellectual property rights. No title to or ownership of the Licensed Software is transferred hereby The Software is protected by the copyright laws of the United states and international copyright treaties.

Export. The U.S. export control laws regulate the export and reexport of technology originating in the United States. User agrees to abide by these laws and their regulations -- including but not limited to the Export Administration Act and the Arms Export Control Act and not to download or transfer, by electronic transmission or otherwise, the Software in violation of such laws.

Termination. This license will terminate automatically if you fail to comply with the limitations described herein. Upon termination, you agree to destroy all copies of the Software.

General. This Agreement represents the entire understanding between you and Electromark regarding the Software and supersedes any prior statements or representations. This license may be amended only by a writing executed by both parties.
